What is FIR (First Information Report)? Format & Structure of FIR

What is fir? FIR is an application to the officer-in-charge of the police station about information of the cognizable offense which would be written or oral.

Anyone who is concerned about the offense can lodge an FIR. According to the Code of Criminal Procedure of Bangladesh and Section 154 FIR can be lodged.

Every Information relating to the commission of a cognizable offence if given orally to an officer in charge of a police station, shall be reduced to writing by him or under his direction, and be read over to the informant; and every such information ,

whether given in writing as aforesaid, shall be signed by the person giving it, and the substance thereof shall be entered in a book to be kept by such officer in such form as the Government may prescribe in this behalf. All above are the main context of section 154 of the CrPc.

Subject: Entry of an Ejahar.

Dear Sir,
I beg to respectfully state that I am the undersigned X, S/O J, Village- Debahat, Police Station- Satkhira, District- Satkhira. I am a businessman and an honest person. I was working at my shop at 7.00 pm. Suddenly, 14 July 2020 at 9.00 pm by a phone call I know that my son Mr. A and fifteen other people were rescued at the border of Sathkhira Debate. After receiving a phone call when I knew that my son and 15 other Familiar faces were rescued on the border. Without delay calling on Mr. Y and Z, we reached the Satkhira border. When I asked my son A and the other 15 victims, they said that Mr. Samad forced them to cross the Satkhira border to send India and he has demanded 1,00,000 lacs taka per head. By the border of Satkhira and forced to cross the debate river by a normal boat which was risky to drop. After the arrest of Mr.Samad, a RAB person also Interrogate him and Samad confessed that he is fully engaged with the international Human trafficking cycle. Also recently has been providing forged documents relating to a contagious disease in his owned hospital. Before the crossing of the border, Mr. Samad and other unknown persons forced and heated my son Mr. A and threatened them not to inform any relatives and police. They also threatened them if they would do anything against their command the following 16 person life will be ended forever. When finally Mr. Samad took action and bit them on the boat to send them to India, hearing of their shouts and cry some people who were law enforcers came and rescued 16 people who are also my son Mr. A and admitted them to the nearest Health Complex and they are under treatment. So, for showing fear and biting among 16 persons with the intention of Trafficking in jobs Mr. Samad committed an offense under Section 6/7/9 of the prevention and human trafficking act. 2012. I am late for a few hours to lodge the FIR because of transferring my son and others to the hospital.

I, therefore, pray and hope that you would be kind enough to regular cases and present the above miscreants before the court of law for trial and punishment.

CONCLUSION

By analyzing all the above case decisions we see that the FIR has no evidentiary value in a case and also some judgment comments it has some evidentiary value in practical. So, it’s clear that the evidentiary value of the FIR depends on the fact.
